§ 26-44. Delinquent charges.

(a)

The owner of record of each residential dwelling unit shall be liable for waste collection charges for each unit. The due date of payment shall be January 16 of each year. Penalties for delinquent charges shall be assessed in the amount of ten percent per month or a portion thereof until paid. The municipal treasurer or his designee shall have authority to issue summons to the municipal court for violation of this chapter. Any amount delinquent after 90 days of the due date shall constitute a violation of this chapter.

(b)

The town shall be entitled to sue for any unpaid garbage collection fees in an action brought in the municipal court or any other court of competent jurisdiction. The municipal court is specifically authorized to grant a money judgement should it find that garbage collection fees are delinquent.
