§ 2-353. Authority to contract for professional services.

  • The town administrator has the authority to contract for professional services that are customarily procured on a fee basis rather than by competitive bidding up to the certified dollar limit as described in section 2-352. For procurement of professional services on a fee basis that exceeds the certified dollar amount approval will rest with the town council.

    (1)

    Consultant services. For the purpose of this section, consultant services shall be defined as an individual, partnership, corporation or any other legally established organization performing and/or providing consulting services for the town. The town has the right of control as to the result to be accomplished but not as to the details and means by which that result is to be accomplished.

    (2)

    Employee services. For the purpose of this section, employee services shall be defined as an individual performing services directly for the town. The town has the right of control not only as to the result to be accomplished by the work but also as to the details and means by which that work is to be accomplished.

    (3)

    Employment services. For the purpose of this section, employment services shall be defined as an individual performing services indirectly for the town and whose services are obtained through a private employment agency. The employee-employer relationship exists between the private employment agency and its employee.

    Other than services listed in paragraphs (1)—(3) above; professional services may also include, but not be limited to the following:

    Lawyers,

    Accountants,

    Architects,

    Engineers.
