§ 22-143. Public consumption of alcoholic beverages.

  • It shall be unlawful for any person to consume any alcoholic liquor, beer, wine or to possess any open container of the same in any publicly owned area, including but not limited to, public highway, street, road, parking lot, tree zone, park, or parking garage within the town not licensed for on-premises consumption of alcoholic beverages.

    Exemption: Any portion of a publicly owned area covered by an encroachment ordinance permitting use of the publicly owned area by an operator that is licensed to sell beer, wine or other alcoholic beverages for on-premises consumption.

    Penalty: Any person found to have violated this ordinance shall be guilty of a misdemeanor and subject to a fine of up to $500.00 or imprisoned for not more than 30 days, or both, upon conviction.
