§ 1-8. General penalty.

  • (a)

    Enumerated; continuing violation. Whenever in this Code or in any ordinances any act is prohibited or is declared to be unlawful or an offense, or whenever in this Code or in any ordinance the doing of any act is required or the failure to do any act is declared to be unlawful, where no specific penalty is provided therefor, the violation of any such provisions of this Code or any such ordinance shall be punished by a fine not exceeding $500.00 or by imprisonment not exceeding 30 days; provided, however, that no penalty shall exceed the penalty provided by state law for similar offenses. In addition, the municipal judge may order restitution in an amount not to exceed $5,000.00. In determining the amount of restitution, the judge shall determine and itemize the actual amount of damage or loss in the order and may set an appropriate payment schedule. Each day any violation of any provision of this Code or of any such ordinance shall continue shall constitute a separate offense.

    (b)

    Violations of rules, regulations and orders. Except as otherwise provided in this Code, the violation of any rules, regulations or orders promulgated by any officer or agency of the town under authority vested in him or it by law, or by the provisions of this Code or any ordinance or resolution, shall be unlawful.

    (c)

    Liability of corporations or other such organizations and agents for violations.

    (1)

    Any violation of this Code by any officer, agent or other person acting for or employed by any corporation or unincorporated association or organization, while acting within the scope of his office or employment, shall in every case also be deemed to be a violation by such corporation, association or organization.

    (2)

    Any officer, agent or other person acting for or employed by any corporation or unincorporated association or organization shall be subject and liable to punishment as well as for the violation by it of any provision of this Code, where such violation was the act or omission, or the result of the act, omission or order of any such person.
